Terms of Use — SomnoMac

1. Publisher

SomnoMac is published by SASU THOMERA, a single-shareholder simplified joint-stock company (société par actions simplifiée unipersonnelle), registered with the RCS de Thionville under number 102 382 876, whose registered office is located at 62 route de la Croix Hepich, 57100 Thionville, France.

2. Purpose

These Terms of Use govern the use of the SomnoMac software ("the Software"), which makes it possible to run the DOMINO / SomnoScreen software on macOS and to establish the connection with a SOMNO HD device.

SomnoMac is a technical integration tool. It does not provide, modify or sell DOMINO. The DOMINO software is published by SOMNOmedics and remains subject to its own license. The user must hold their own valid DOMINO license; the user supplies their own DOMINO installer.

3. License to use

THOMERA grants the user a personal, non-exclusive and non-transferable right to use SomnoMac, limited according to the plan subscribed to (per workstation, or per multi-workstation clinic). The license is tied to the hardware fingerprint of the authorized Mac(s).

The following are prohibited: copying, resale, redistribution, decompilation, reverse engineering and circumvention of the licensing mechanisms.

A 30-day free trial may be granted, once per machine only. Upon expiry, access is suspended until a license is purchased.

SomnoMac, its code, its trademark and its graphic elements are the exclusive property of SASU THOMERA. DOMINO, SomnoScreen and SOMNO HD are trademarks of SOMNOmedics. macOS is a trademark of Apple Inc. None of these trademarks implies any partnership or affiliation.

These Terms apply for the entire duration of use. THOMERA may amend them; the applicable version is the one in force on the date of use, published on somnomac.com.

10. Governing law and disputes

These Terms are governed by French law. Failing an amicable resolution (contact@somnomac.com), jurisdiction lies with the courts of Thionville.
